The NLRB settled a jurisdictional dispute at Eastern Concrete Materials, Mt. Vernon, N.Y., determining that Operating Engineers Local 137 and Teamsters Local 456 members are entitled to perform, respectively, mechanic and loader operator and batch and yard work. Laborers Local 731 had claimed jurisdiction for the four classifications based on an agreement with the facility’s prior owner, Riverside Concrete Corp., which sold the assets to Eastern Concrete two years ago. The plant’s small staff had been represented by Local 731, owing to Laborers’ assignment of mechanic, loader, batch, and yard work at Riverside Concrete New York City operations. After closing on the assets, Eastern ConcreteÛrespecting area practice for Mt. Vernon and the surrounding Westchester CountyÛsigned agreements with Locals 137 & 456.
