FMCSA replicates mixer driver exemption for concrete pump peers

American Concrete Pumping Association members have secured a five-year exemption from the Federal Motor Carrier Safety Administration requirement that short-haul drivers utilizing the records of duty status exception return to their normal work reporting location within 12 hours of clocking in. It enables all concrete pump operators, pumping companies, and truck drivers who run concrete pumps to use the short-haul exception but return to their work-reporting location within 14 hours.

From a record, 82-contestant field, Chris Harrison of Mobley Concrete Co. in Russellville, Ark., took the NRMCA National Mixer Driver Championship in Nashville, staged September 18-19 during the group’s 2016 ConcreteWorks. After placing second in the 2015 competition (San Antonio), Harrison earned a $2,500 cash prize from the NRMCA’s Truck Mixer Manufacturers Bureau (TMMB) for this year’s first place finish.

The National Ready Mixed Concrete Association’s 19th Annual Ready Mixed Concrete Delivery Professional Driver of the Year program recognizes two industry veterans from a pool of outstanding nominees across the country. The NRMCA Operations, Environmental and Safety Committee assembled a panel of judges to weigh nominees’ competence, driving skills, number of years without an on- or off-road accident, and colleague or customer testimonials. Judges awarded Driver of the Year honor to Eastern Concrete Materials’ Edward “Eddie” Rieper and Runner-Up honor to Concrete Supply Co.’s Henry “Pete” Scarborough. NRMCA-affiliated Truck Mixer Manufacturers Bureau will award Rieper $5,000, and Scarborough $1,000. Both drivers will be formally honored this month during the NRMCA Annual Convention in Orlando.

Discharged, union-wise dump and mixer driver prevails in back pay case

In one of its final 2014 decisions, the NLRB adopted an administrative law judge’s order that Fairmont Heights, Md.-based Pessoa Construction Co. pay a former dump truck driver $95,000 in back wages. It settles protracted pay period and calculation proceedings triggered by an initial agency decision determining the highway contractor violated the National Labor Relations Act when it terminated William Membrino for “union activities.”
