Commerce staff has announced affirmative final determinations in antidumping duty (AD) investigations of steel concrete reinforcing bar imports from Japan and Turkey, plus affirmative final determination in the countervailing duty (CVD) investigation of rebar imports from Turkey.
In the Japan AD investigation, mandatory respondents Jonan Steel Corp. and Kyoei Steel Ltd. did not respond to Commerce’s AD questionnaires; thus Commerce applied adverse facts available (AFA) and assigned the companies an AD rate based on the highest petition rate of 209.46 percent. Commerce assigned the final AD margin of 206.43 percent to all other producers/exporters of steel concrete reinforcing bar from Japan, based on the standard practice of averaging all petition rates when there are no calculated dumping margins for the mandatory respondents available.
In the Turkey AD investigation, mandatory respondents Habas Sinai ve Tibbi Gazlar Istihsal Endustrisi A.S. (Habas) and Icdas Celik Enerji Tersane ve Ulasim Sanayi A.S. (Icdas) received final dumping margins of 5.39 percent and 8.17 percent, respectively. Commerce applied partial AFA in determining the rate for Icdas because it did not report the manufacturer of certain downstream home market sales. Commerce assigned the final dumping margin of 6.94 percent to all other producers/exporters of steel concrete reinforcing bar from Turkey. In the Turkey CVD investigation, Commerce calculated a final subsidy rate of 16.21 percent for the mandatory respondent Habas.
As a result of the final affirmative determinations, Commerce will instruct U.S. Customs and Border Protection to collect cash deposits based on these final rates. The department commenced the investigations in response to petitions from the Rebar Trade Action Coalition and its individual members: Byer Steel Group, Inc. (Ohio), Commercial Metals Co. (Texas), Gerdau Ameristeel U.S. Inc. (Fla.), Nucor Corp. (N.C.), and Steel Dynamics, Inc. (Ind.).
The U.S. International Trade Commission (ITC) is scheduled to announce its final determinations on or about June 29, for Japan and/or Turkey. If it makes affirmative final determinations that imports of steel concrete reinforcing bar from Japan and/or Turkey materially injure, or threaten material injury to, the domestic industry, Commerce will issue AD and CVD orders. If the ITC makes negative determinations of injury, the investigations will be terminated.
